1. Identification and acceptance

1.1 Service provider

The Platform at https://keystone-observatory.com (hereinafter the "Platform") is operated by KEYSTONE. (hereinafter "KEYSTONE.", "we" or "our"):

1.2 Acceptance of terms

By accessing or using the Platform - whether as a visitor, registered user or subscriber - you confirm that you have read, understood and agree to be bound by these Terms and Conditions of Use (hereinafter "Terms"), as well as our Privacy Policy and Cookie Policy.

If you do not accept these Terms in their entirety, you must immediately cease using the Platform.

2. Description of the service

2.1 What is KEYSTONE.

KEYSTONE. is a market intelligence platform that aggregates, processes and publishes global sectoral statistical data on mineral resources and natural stone (marble, granite, limestone, slate and other dimension stones). Our content includes:

  • Statistical data and dashboards (exports, imports, production, prices) in interactive format;
  • Publications: market studies, outlooks and market notes, produced with documented methodology;
  • Public area (freemium): selected content available free of charge, with or without registration;
  • Members area (premium): full publication and data library accessible via paid subscription.

2.2 Service scope

KEYSTONE. reserves the right to modify, suspend or discontinue, in whole or in part, any feature of the Platform at any time, with or without prior notice, without any liability to KEYSTONE., except as required by law.

3. Registration and user account

3.1 Creating an account

Access to certain Platform content and features requires a registered user account. By registering, you agree to:

  • Provide true, accurate, current and complete information;
  • Promptly maintain and update your registration information as necessary;
  • Not create accounts on behalf of third parties without their express authorisation.

3.2 Account security

You are solely responsible for maintaining the confidentiality of your access credentials (email address and password) and for all activities carried out under your account. In the event of unauthorised access or suspected compromise of your account, you must immediately notify KEYSTONE. at hello@keystone-observatory.com.

3.3 One account per user

Each individual may maintain only one active personal account.

4. Subscription plans and payments

4.1 Plan types

KEYSTONE. offers different access levels as described on the Platform Pricing page, which may include:

  • Open Plan: free access to selected content, no payment required;
  • Data Plan: single-seat access to all dashboards and monthly bulletins, without publications, data export or citation rights;
  • Professional Plan: full single-seat access to all dashboards (including Excel export of their data) and publications, with non-commercial citation rights.

Details, features and prices of each plan are set out on the Pricing page and may be changed pursuant to Clause 4.5.

4.2 Billing and automatic renewal

Paid subscriptions are billed in advance on a monthly or annual basis as selected, and renew automatically at the end of each billing period unless cancelled by the user in accordance with Clause 4.4.

4.3 Payments

Payments are processed by a certified payment service provider (e.g., Stripe). By providing your payment details, you authorise KEYSTONE. to charge the subscription amount to the payment method provided. All transactions are subject to confirmation by the payment provider.

Prices shown on the Platform are expressed in euros (EUR) and include VAT at the applicable legal rate unless otherwise indicated.

4.4 Cancellation

You may cancel your subscription at any time through your account management area. Cancellation takes effect at the end of the current billing period; amounts already paid are non-refundable, except as provided in Clause 4.6 or as required by law.

4.5 Price changes

KEYSTONE. reserves the right to change subscription prices, with at least 30 days' prior notice to users by email. If you disagree with the change, you may cancel your subscription before the effective date of the new price, without penalty.

4.6 Right of withdrawal

For users who qualify as consumers under applicable EU consumer protection legislation, the right of withdrawal is available for 14 days from the date of contract conclusion, without giving any reason, provided the service has not been fully performed during that period with the consumer's prior consent.

5. Intellectual property

5.1 KEYSTONE. content

All content made available on the Platform - including, without limitation, texts, processed data, analyses, methodologies, charts, visualisations, dashboards, reports, market studies, outlooks, trademarks, logos, design and source code - is the property of KEYSTONE. or its licensors, and is protected by applicable copyright, trademark and intellectual property legislation.

5.2 Licence of use

KEYSTONE. grants you, for the duration of your subscription, a non-exclusive, non-transferable and revocable licence to access and use the Platform's content for your own or your organisation's internal professional purposes.

This licence does not entitle you to:

  • Reproduce, distribute, publish or transmit KEYSTONE. content to third parties without prior written authorisation;
  • Use the content to create competing products or services;
  • Remove or alter copyright notices, trademarks or other proprietary markings;
  • Scrape, automatically extract or bulk download data from the Platform.

5.3 Citation and reference

Users may quote excerpts from KEYSTONE. publications in academic work, internal reports or communications, provided the source is expressly identified as: "KEYSTONE. – Minerals Data Observatory, [publication title], [year]", and no substantial portion of the content is reproduced.

5.4 Public-source data

The raw statistical data incorporated in KEYSTONE. analyses originates from public sources (e.g., UN Comtrade and Eurostat). KEYSTONE. does not claim ownership of such raw data, but their selection, processing, harmonisation and presentation constitute original protected works.

6. Acceptable use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. The following are expressly prohibited:

  • Accessing or attempting to access the Platform by unauthorised means, including circumventing authentication mechanisms;
  • Introducing viruses, malware or any malicious code into the Platform;
  • Taking any action that may overload or impair the Platform's infrastructure;
  • Using robots, scrapers or automated means to collect content without authorisation;
  • Creating false accounts or using the Platform for fraudulent purposes;
  • Violating third-party rights, including intellectual property or privacy rights;
  • Using the content for market manipulation, insider trading or other illegal activities.

KEYSTONE. reserves the right to suspend or terminate accounts that breach these rules, without prejudice to any other legal remedies.

7. Data disclaimer

7.1 Informational nature

The content available on the Platform is for informational and market intelligence purposes only. It does not constitute financial, investment, legal, tax or any other form of professional advice. You assume full responsibility for any decisions made based on data or analyses provided by KEYSTONE.

7.2 Data accuracy

KEYSTONE. strives to ensure the accuracy and currency of published data, but cannot guarantee the completeness, precision or up-to-date nature of all information, as this partly depends on external sources. KEYSTONE. accepts no liability for errors, omissions or outdated information originating from primary sources.

7.3 Projections and outlooks

Projections, estimates and forward-looking scenarios are based on documented methodologies and reasonable assumptions at the date of publication. Actual future results may differ materially from projections presented. KEYSTONE. makes no warranty as to the achievement of any projection.

7.4 Source data availability

The statistical data published on the Platform is sourced from public institutions (UN Comtrade and Eurostat) and reflects the data those institutions make available, which depends in turn on each country reporting its trade to them. KEYSTONE. does not control and accepts no liability for the availability, timeliness, completeness or revision of source data, including delays in reporting by individual countries — which, for some countries, may exceed six months. The most recent periods presented may be provisional and subject to subsequent revision.

8. Limitation of liability

To the fullest extent permitted by applicable law:

  • KEYSTONE. shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of data or business interruption, arising from the use or inability to use the Platform;
  • KEYSTONE.'s total liability to you for any cause shall not exceed the total amount paid by you to KEYSTONE. in the 12 months preceding the event giving rise to the liability;
  • The above limitations do not apply in cases of wilful misconduct, gross negligence, or where the law prohibits the limitation of liability (in particular under consumer protection rules).

9. Third-party links and content

The Platform may contain links to third-party websites (e.g., data sources such as UN Comtrade and Eurostat) or embed third-party data. KEYSTONE. does not control those external resources and is not responsible for their content, privacy policies or practices. The inclusion of a link does not imply endorsement by KEYSTONE.

10. Account suspension and termination

10.1 Suspension by KEYSTONE.

KEYSTONE. reserves the right to suspend or terminate any user's access, with or without prior notice, in the following cases:

  • Breach of these Terms;
  • Non-payment of amounts due;
  • Suspected fraudulent or abusive activity;
  • Legal requirement or court order.

10.2 Termination by the user

You may close your account at any time through account settings or by written request to hello@keystone-observatory.com. Closure does not entitle you to a refund of amounts already billed.

10.3 Effects of termination

Upon account closure, access to premium content ceases immediately. Account data is retained in accordance with the Privacy Policy.

11. Modifications to these Terms

KEYSTONE. may modify these Terms at any time. Changes are communicated by email to registered users and published on the Platform with the revision date, with a minimum of 15 days' prior notice for material changes.

Continued use of the Platform after the effective date of changes constitutes acceptance of the updated Terms. If you disagree, you must close your account before the effective date.

12. Governing law and dispute resolution

12.1 Governing law

These Terms are governed by and construed in accordance with Portuguese law, without prejudice to any mandatory consumer protection rules that may apply.

12.2 Dispute resolution

In the event of a dispute, the parties agree to seek an amicable resolution. In the absence of agreement, the courts of Lisbon, Portugal shall have jurisdiction, without prejudice to a consumer user's right to bring proceedings before the courts of their place of residence or to use alternative dispute resolution (ADR).

12.3 Alternative dispute resolution

Consumer users may refer disputes to ADR entities. For more information: www.consumidor.gov.pt (Portuguese Consumer Portal) or https://ec.europa.eu/consumers/odr (EU Online Dispute Resolution platform).

13. General provisions

  • Severability: if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect;
  • No waiver: failure to exercise any right under these Terms shall not constitute a waiver of that right;
  • Entire agreement: these Terms, the Privacy Policy and other policies published on the Platform constitute the entire agreement between you and KEYSTONE. with respect to the subject matter hereof;
  • Language: in the event of any inconsistency between versions in different languages, the Portuguese version shall prevail.
